Data Protection and Privacy

·         There is a 'factory reset' function within the settings menu, which disconnects any accounts linked to the system and deactivates Kia Connect services.

·         There are different ways for customers to delete their personal data from the system

·        To delete your personal data connected to your car, you can remove the car (VIN) from your Kia Connect App or reset the Kia Connect system in your car. To delete your personal data linked to the Kia Account, you then need to log in to the Kia Account portal and perform the deletion request.

·      You can contact us by visiting the Contact Us section on this Website and selecting Kia Account for any Account related questions.

·         Kia Connect may sell customers’ personal data but only following customers’ consent and to deliver services to the customer via a 3rd-party company.

·         Certain third parties may receive your personal data to process it on behalf of Kia Connect to make the Kia Connect service as helpful and useful as possible

·         Any access to your personal data is restricted to those individuals that have a need to know in order to fulfill their job responsibilities. They will be subject to contractual obligations to implement appropriate security measures to safeguard any personal customer data

• You can request that any personal data gathered with your consent is deleted at any time
• Certain data, such as personal data contained in contracts or business letters, may be subject to statutory retention requirements, and may require us to retain this data for up to 10 years
• Detailed deletion request are sent to the DPO
• Questions that concern local law (e.g. traffic law) will be directly sent to the local DPO

• We only store personal data to the extent necessary for the performance of our obligations to you, in accordance with data protection laws

•     The Kia Connect service has been developed to incorporate the EU General Data Protection Regulation:
o Data Security: Kia Connect incorporates ‘security by design and default’ principles, ensuring customer data is safely handled and stored
o Privacy: The services have been designed to ensure personal information remains private
o Data Protection Management: We at Kia have implemented a data protection management team that is monitoring the fulfilment of data protection regulations and is involved in our work and the development of our services.
o Partner Management: We only entrust your personal data to carefully preselected service partners within the EU/EAA. If some of the recipients of your personal data will be located outside of the EU/EEA, e.g. in the Republic of Korea, we provide appropriate safeguards with the recipients or take other measures to provide an adequate level of data protection.
o Transparency: We provide comprehensive descriptions per service about which data is collected and for which purposes, limiting personal data use to the minimum

·         Kia defines ‘personal data’ as any information relating to an identified or identifiable natural person (‘datasubject’);

·         Kia Connect carefully classifies your personal data in different categories and clusters (e.g. based on the purpose of processing, special security requirements for sensible data) to enable a more efficient use and protection of personal data.

·         Kia Connect collects data that are necessary to conclude or perform the contract for the provision of the Kia Connect Services between you as our customer and Kia Connect. If you gave us your consent, we also collect the data, you are providing to us based on this consent.

·         Kia Connect collects and processes your personal data only insofar as the collection and processing is necessary for the conclusion or the performance of the contract for the provision of the Kia Connect Services or legitimate interests

• Your personal data is stored in Data Centers in Germany and the European Union.

• Kia has implemented IT-Security and data protection concepts as well as an IT-Security management system to keep your data secure.
• Our data processors are certified according to international IT-Security standards, e.g. ISO/IEC 27001 Information technology – Security techniques – Information security management systems
• As far as possible we pseudonymize and anonymize your personal data.

• Kia shares personal data only with preselected service partners and only insofar as the sharing is necessary for the provision of the Kia Connect Services

• Kia Connect shares personal data with the other Kia companies only insofar as the sharing is necessary for the provision of the Kia Connect Services or if you have given us your consent to provide your data to other Kia companies.

• Kia UVO Connected shares personal data with the other Kia companies only insofar as the sharing is necessary for the provision of the UVO Services or if you have given us your consent to provide your data to other Kia companies.

• Kia Connect shares personal data with the other Kia companies in Europe only insofar as the sharing is necessary for the provision of the Kia Connect Services or if you have given us your consent to provide your data to other Kia Motor companies.
• For the purpose of providing the App Services we also need to transfer data to our data processors.
• Some of the recipients of your personal data will be located or may have relevant operations outside of your country and the EU/EEA, e.g. in the Republic of Korea, where the data protection laws may provide a different level of protection compared to the laws in your jurisdiction and with regard to which an adequacy decision by the European Commission does not exist. With regard to data transfers to such recipients outside of the EU/EEA we provide appropriate safeguards, in particular, by way of entering into data transfer agreements adopted by the European Commission (e.g. Standard Contractual Clauses (2010/87/EU and/or 2004/915/EC)) with the recipients or taking other measures to provide an adequate level of data protection.

• Pursuant to applicable data protection law you may have the right to: request access to your personal data, request rectification of your personal data; request erasure of your personal data, request restriction of processing of your personal data; request data portability, and object to the processing of your personal data.

• We do not engage in automated decision-making including profiling in connection with the App Services unless we have expressly notified you of such automated decision-making including profiling by other means.

• We process your personal data for other purposes only if we are obligated to do so on the basis of legal requirements (for example, transfer to courts or criminal prosecution authorities), if you have consented to the respective processing or if the processing is otherwise lawful under applicable law. If processing for another purpose takes place, we will provide you with additional information, if appropriate.
